Unanimous Not Guilty verdict for Martin McCarthy in multi-defendant Murder case
Martin McCarthy represented a young man charged with Murder along with 5 others. He appeared against a Prosecution team of QC and junior and with several other defendants being represented by QC’s. The case was built around CCTV and the Crown alleged a joint enterprise attack with an intent to cause really serious harm. The defence involved a cut throat attack by one defendant who admitted Manslaughter but denied Murder. Martin's client was the only one acquitted of Murder. The jury convicted instead of the lesser offence of Manslaughter based on his actions in the joint attack. In doing so, the jury were persuaded that he was the only defendant who lacked the intent for Murder.
