James Ortiz successfully pursues abuse of process application
James’ client faced three counts of non-fatal strangulation in the Crown Court.
However, James identified several issues with the investigation and disclosure process, and pursued an application to stay proceedings as an abuse of process.
After initially opposing James’ submissions, the Crown offered no evidence against James’ client. Therefore, not guilty verdicts were formally entered on all counts against James’ client.
