James Elvidge Secures Acquittal in Stranger Rape Trial at Derby Crown Court.
The defendant was accused of raping the complainant at a party, having only met that evening. The defence was one of reasonable consent. The prosecution served vast quantities of third-party material that was subject to complex s.41 YJCEA 1999 applications to admin into evidence.
HHJ Smith, the Resident Judge, stated that the cross examination of the complaint by Mr Elvidge was “one of the most sensitive and professional [he had] heard in years”.
